Our new Guide to how we intervene replaces and updates the former Intervention Strategy. It explains how we would use each of the statutory powers of intervention in the Housing (Scotland) Act 2001 in both local authorities and Registered Social Landlords. The Guide sets out our interim approach. The Scottish Government has recently begun consultation on a draft Bill which would modernise social housing regulation. The approach set out in the Guide will remain in place until any new legislation takes effect.
The changes in our approach to intervention are not radical; they are about using the existing statutory powers more effectively to protect the interests of tenants and the sector as a whole.
We will not apply these powers routinely but only where performance problems are serious, and where the service provider is not willing, or not able, to take action. The Guide confirms that we are still committed to giving the regulated body the opportunity to improve its performance.
