Introduction – purpose and aims of the publication scheme
The Scottish Government’s publication scheme is required by section 23 of the Freedom of Information (Scotland) Act 2002 (the Act). As a government agency, The Scottish Housing Regulator’s publication scheme is included as a sub-scheme of the main Scottish Government scheme.
Under the Act the Scottish Government is required to specify:
• the classes of information it publishes or intends to publish;
• how information is published; and
• whether the information is available free of charge or on payment of a fee.
The scheme has been designed to be as inclusive as possible and it is intended to be flexible to allow for future expansion and/or revision of the scheme. The Chief Executive of The Scottish Housing Regulator has overall responsibility for this publication scheme. Contact details are provided in section 8 of this scheme.
About The Scottish Housing Regulator
The Scottish Housing Regulator exercises the powers of regulation and inspection that are set out in the Housing (Scotland) Act 2001.
Our overall purpose is to regulate effectively to:
• protect the interests of current and future tenants, and other service users;
• ensure the continuing provision of good quality social housing, in terms of decent homes, good services, value for money and financial viability; and
• maintain the confidence of funders.
Everything we do is set within the Scottish Government’s overall purpose of focusing government and public services on creating a more successful country, with opportunities for all of Scotland to flourish, through increasing economic sustainable growth. And we contribute to the Scottish Government’s five strategic objectives, aimed at creating a country that is wealthier and fairer; healthier; safer and stronger; smarter; and greener. We have a particular connection with the third objective of helping local communities to flourish; becoming stronger, safer places to live, offering improved opportunities and a better quality of life.
Scottish Ministers have published a Ministerial Code of Practice for The Scottish Housing Regulator. This Code details how the Scottish Ministers intend to use their powers to regulate and inspect Registered Social Landlords (RSLs) and the landlord, homelessness and factoring functions of local authorities through the agency. Our work is overseen by a Regulation Board made up of the Chief Executive, senior staff of the organisation and up to four non-executive directors. The Board ensures that the regulator makes the best use of its own resources, is free from any inappropriate influence, acts in the best interests of current and future tenants and service users and maintains the confidence of funders.
Information on The Scottish Housing Regulator and our performance against targets will be published in our annual report and corporate plan. Copies of these documents will be available under this publication scheme.

Information on our website will be available free of charge (that is, there is no charge by us, although the user would of course have to meet any charges made by their internet service provider, and personal printing costs).
For those without access to the website a single printout of the website (or a hard copy of the document except where indicated) can be requested. These will be provided free of charge except where indicated.
Requests for multiple printouts of material on the website or for multiple hard copies may attract a charge for the cost of printing, photocopying, postage etc. Photocopying costs will not exceed £1 per 10 pages.
Although we will normally provide a single copy free of charge we may also charge where a substantial number of multiple documents are required to respond to a request. Printing and photocopying charges will also not exceed £1 per 10 pages.
If we are going to charge you, we will tell you at the time of your request and these would be payable in advance.
The material listed in this publication scheme is covered by Crown copyright unless stated otherwise. The supply of documents under Freedom of Information does not give the person or organisation who receives them an automatic right to re-use documents, for example by making multiple copies, publishing and issuing copies to the public. Such re-use is subject to permission given, usually in the form of a copyright licence, by copyright holder. In the case of Crown and Scottish Parliamentary copyright material, licence would be available from the Office of Queen’s printer for Scotland (OQPS). The Scottish Housing Regulator is required to comply with Public Records legislation in respect of all documents that it creates and holds. The current policy and procedures in relation to records management are set out in the Scottish Government records management manual which is available under its publication scheme. These procedures set out the lengths of time for which all types of documents must be held.
Listed below are the classes of information which The Scottish Housing Regulator publishes or intends to publish. All information listed under these classes are (except where indicated) available on request.
We may withhold information from any of the classes of information listed below where: we consider that disclosure may seriously prejudice law enforcement, legal proceedings or our regulatory or enforcement activity; or where the disclosure is otherwise prohibited by law. We may also withhold information if its disclosure would breach the law of confidentiality or seriously prejudice the commercial interest of any persons or organisations. We may also withhold information which is personal information under the Data Protection Act 1998.
